Acceptable Use Policy

Purpose

This Acceptable Use Policy ("AUP") governs how clients and any third parties may interact with services provided by Crosswind Studio, including but not limited to online galleries, delivered digital files, website content, and any communication platforms used in connection with My services. This AUP supplements My Terms of Service and Privacy Policy.


By accessing any Crosswind Studio service, gallery, or delivered content, you agree to comply with this AUP.


Permitted Uses

Clients who have received delivered images under a valid session agreement may:

  • View, download, and retain personal digital copies of their delivered images
  • Share images for personal, non-commercial purposes (e.g., social media, personal websites, gifts) with proper attribution to “Crosswind Studio”
  • Print images for personal use through licensed consumer print services
  • Adapt or edit images for personal non-commercial use, provided adaptations are shared under the same CC BY-NC-SA 4.0 license and clearly attributed


Prohibited Uses

The following uses are strictly prohibited without prior written authorization from Crosswind Studio:

Commercial Use:

  • Using delivered images in advertising, marketing, or promotional materials for any business, product, or service
  • Licensing, sublicensing, selling, or transferring images or any usage rights to third parties
  • Using images in stock photo libraries, commercial publications, or paid media
  • Printing images for resale through any retail or commercial outlet

Misuse of Delivered Images:

  • Removing, cropping, or obscuring watermarks, credits, or attribution from any image
  • Altering images in any way that misrepresents or disparages Crosswind Studio or the photographer’s work
  • Using images in a context that is defamatory, obscene, harassing, or otherwise unlawful
  • Using images in a way that violates the privacy, dignity, or rights of any individual depicted

Gallery & System Misuse:

  • Sharing private gallery links or download codes publicly without consent from Crosswind Studio
  • Attempting to download, scrape, or bulk-export images beyond what is provided in your session package
  • Attempting to circumvent gallery security, access controls, or password protections
  • Using automated tools, bots, or scripts to access or interact with any Crosswind Studio platform
  • Uploading, transmitting, or sharing any malicious code, spam, or harmful content through any channel associated with Crosswind Studio

Identity & Misrepresentation:

  • Representing delivered images as your own original work or claiming copyright ownership
  • Impersonating Crosswind Studio or misrepresenting any affiliation with My business
  • Providing false or misleading information during the booking or session process


Third-Party- Sharing

You may share your gallery link or downloaded images with immediate family members and close personal contacts for personal viewing. You may not post gallery access links in public forums, social media groups, or any publicly accessible location without My written consent, as this may expose gallery content beyond the intended audience.


Social Media Usage

When sharing delivered images on social media for personal, non-commercial use:

  • You must credit “Crosswind Studio” in the post caption or description
  • You may not use the images as sponsored content or in paid partnerships without a separate commercial licensing agreement
  • You may not apply filters or edits that substantially alter the image in a way that misrepresents My work


Enforcement & Consequences

Crosswind Studio reserves the right, at My sole discretion, to take any or all of the following actions in response to violations of this AUP:

  • Issue a written notice of violation and demand for cure
  • Revoke gallery access or remove content from hosted platforms
  • Terminate the client relationship and cancel any outstanding services
  • Pursue civil remedies under applicable copyright, contract, or tort law
  • Report violations to applicable legal authorities where required or appropriate

Crosswind Studio is not obligated to provide notice prior to taking corrective action when urgent circumstances exist or when repeated violations have occurred.


Reporting Violations

If you become aware of a violation of this AUP — for example, if you observe Crosswind Studio images being misused by a third party — please report it promptly:

Changes to This Policy

I may update this Acceptable Use Policy at any time. Changes will be posted with a new Effective Date. Continued use of My services or galleries after a change constitutes acceptance of the updated policy.


Governing Law

This Acceptable Use Policy is governed by the laws of the State of Illinois, consistent with My Terms of Service and other governing documents.
