Overview
Crosswind Studio ("I", "My", "Me", "The Studio") respects intellectual property rights and expects all clients and users to do the same. This policy outlines My procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512
All photographs and creative works produced by Crosswind Studio are protected by United States copyright law. Copyright vests automatically in the photographer at the moment of capture, regardless of registration status.
My Copyright Ownership
Unless a written transfer of copyright is explicitly executed, I retain full copyright ownership of all images created during any session. Clients receive a limited license to use images as described in the Terms of Service and under the applicable Creative Commons license (CC BY-NC-SA 4.0), not ownership of the underlying copyright.
Unauthorized use of My images — including but not limited to reproduction for commercial purposes, removal of watermarks, use in advertising, or resale — constitutes copyright infringement and may be subject to legal action.
Reporting Infringement of My Work
If you are Crosswind Studio or an authorized representative and believe images have been used without authorization, you may submit a DMCA takedown notice to the infringing platform directly. When submitting, include:
- A description of the copyrighted work being infringed
- The URL or location of the infringing content
- A statement that you have a good faith belief the use is unauthorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature

Reporting Infringement to Crosswind Studio
If you believe that content accessible through My website, galleries, or shared links infringes your copyright, please submit a notice containing the following:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the infringing material and its location on My platform
- Your contact information (name, address, phone, email)
- A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature

Counter-Notification
If you believe content was removed in error, you may submit a counter-notification that includes:
- Your name, address, phone, and email
- Identification of the removed content and its prior location
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your consent to jurisdiction in the Federal District Court for the Northern District of Illinois
- Your physical or electronic signature
Upon receipt of a valid counter-notification, I may restore the content within 10–14 business days, unless the notifying party seeks a court order.
Repeat Infringer Policy
Clients or users who are found to have repeatedly infringed the copyrights of Crosswind Studio or others may have their gallery access revoked, their license terminated, and may be referred to legal counsel without further notice.
No Waiver
This DMCA policy does not constitute a waiver of any legal right or remedy available to Crosswind Studio under applicable copyright law. All rights are expressly reserved.
